And, to anyone saying that he(Ozzy) should have refused the search , that might have worked pre-Patriot act. However, the Constitutional guarantees regarding searches, seizures and invasions of privacy was swept out the window approximately 5 years and 11 months ago regardless of skin color.

Yes. There is a big difference between field sobriety tests and stationhouse breath chemical tests. Roadside breath tests are generally not admissible in court anyway (in most states) because they are considered scientifically unreliable (which is bull, but the law hasn't caught up with the science yet.)
