Friend busted for child porn, wtf?

a decent guy i know left to go work in australia last summer. he was supposed to be back last xmas, still no sign of him. recently i heard he got busted for child porn just before he was due to leave and is in jail. crazy world.

Arcadia police Thursday arrested Phillip Sutliff, 34, of Azusa, on a warrant listing 24 counts of oral copulation, sodomy with a person under 18, penetration by a foreign object, and unlawful sexual intercourse with a minor, the Pasadena Star-News reported. He was being held in lieu of $1.16 million bail.
That was a fellow teacher on our campus, news of that broke yesterday. He was under investigation for the past couple of weeks, but I guess now it's official.

What constitutes child porn, by the way? Say an 18 year-old is dating a 17 year-old, and she sends him some racy photos of herself naked. Because he now possesses naked pics of a minor, is he engaging in child pornography? If he takes the pictures of her, is that kiddie porn? But he could be like 5 months older than her... I dunno, maybe it's 13 or younger?

Wouldn't it depend on the age of this guy's "child" porn? He's 20. I wouldn't consider him a pervert for looking at pictures of naked 15 year-olds. 12 year olds, well, not so good. 6 year-olds, uh. . .
