Make arbitration an aspect of the market, just like everything else should be.

[/ QUOTE ]

K, but what's your preference in a market trial? Arbitrator who fields juries? Or one who doesn't?

[/ QUOTE ]

I have no meaningful way to express my preference, because it's a monopoly.

[/ QUOTE ]

This is the most pathetic AC hijack yet.

I agree. Not sure it's the worst, but it's bad. Nielso's posts in this thread suck.

If I believe I'm innocent of the charge, I think I'd like a panel of experts to be the "jury".

Democracy is the worst political system, except for all the other ones.

Shooting yourself in the toe is the worst way to shoot yourself, except for all the other ones.

Despite this, most people I know simply avoid shooting themselves altogether.

The jury system is the same way. It is certainly flawed, but at the same time it is the best anyone can come up with to consistently meet our definition of justice

One-size-fits-all?

[/ QUOTE ] You seem to have grown mighty fond of that sophistry, haven't you? It's the kind of "logic" which little kids use to prove 1 = 0.

For your information, the premise is all wrong : Democracy is not the worst political system.

Yes, it's stupid. Just like the phrase I mock. Finding the least unpleasant way to do something objectionable isn't a justification for doing that objectionable thing.

What does "except" mean to you, exactly?

I'm struggling to remember which thread it was (hehe), but he did have a good contribution or two. But yeah, for the most part, he's really batty.

I understand Nielso has an agenda, but I'd love, just once, only one time, to hear if he actually has an opinion on anything other than the legitimacy of the state. He just won't respond, unless he can work in a state-sucks reference. Does he think juries are stupid? Does he like cheeseburgers?

Nielsio on the state:

"I would not, could not, in the rain.
Not in the dark. Not on a train.
Not in a car. Not in a tree.
I do not like it, Sam, you see.
Not in a house. Not in a box.
Not with a mouse. Not with a fox.
I will not like it here or there.
I do not like it anywhere!"

While this is true, Nielso *has* already sampled the state, whereas the protaganist of Green Eggs and Ham had not tried GE&H before deciding he didn't like them.

The worst part about it, IMO, is letting the lawyers pick the jurors. Might as well let Joe Torre and Terry Francona pick the umpires: they'll pick people who are prone to decide the way they want the decision decided, instead of people who are, excuse the expression, fair and balanced.
