Default Ruling on an incorrectly mucked hand?

Here's the story.

Loose passive guy limps in early position. He's an old, mean bastard and I don't like him. I don't think he knows this, because I do my absolute best to never ruffle any feathers at a table. Folds to me in the SB. I raise. BB folds, and the limper calls. The next thing I know, the pot is being pushed to me. The dealer mucked my hand. She gives it back to me, except it's not the same hand. One card is the same, but one is not (ATs-AJs). I say "This is not my hand." The old man loses it and starts screaming at me, saying things along the lines of "I'm not falling for that!" So what's the ruling?

We ended up chopping the pot as is. Fair?

Should I have not said anything and taken the flop? Really dishonest?

How did the dealer get your hand? If he called and yours is accidentally mucked, you lose. 1st rule in poker, always protect your hand, it's your responsibility to protect your cards and action 100% of the time.

Be thankful you got to chop the pot. You should have lost the whole thing, even if by mistake. The house does not take responsibility for hands mucked inadvertantly.

My cards were by my chips (well behind the betting line). The dealer pushed the pot and took my cards.

I thought they would rule this way, as well.

You'll have to pay more attention and when you see the dealer put down the deck to push the pot, you stop him/her and say the hand isn't over yet. That's about the best you can do other than to put your hand on your cards like I do, without covering them completely from the cameras.

Looks like the dealer forgot about the limper.

I can't see a house doing anything but splitting the pot here. Even though he should've protected his hand better, the house giving the pot to the limper when one of their employees screws up doesn't usually sit well with anyone at the table.

Given that action, no way they give that to the limper.

A chop seems fair. Protect your hand.

The sequence and timing of this depends. If they push you the pot and then take yuor cards and the limper sits there watching hoping to have your hand ruled dead his hand is dead.

Doing something like this is well within this player's range.

And sitting there letting the dealer push you the pot and muck your cards is within your range.
