Re: Trip Report: Jail
[ QUOTE ]
[ QUOTE ] Gave in and skimmed the story. No miranda rights read stuck out the most. If you got charged with anything it woulda been dropped based on that fact alone. [/ QUOTE ] Yeah man, right on. Idiot: Officer X never read me my miranda rights Judge: Officer X, is this true? Officer X: No. [/ QUOTE ] How about. They don't have to read anyone their rights ever? Tons of people are convicted every year without being read Miranda rights, because ONLY INFORMATION GIVEN UP AFTER YOU'RE ARRESTED is excluded if you aren't made aware of your rights. You don't get off because he didn't read you your rights morons. |

[/ QUOTE ] This is wrong.. not sure why everyone thinks this, because they see the tv cops read people their rights as they arrest them? The only time they are obligated to inform you of your rights is if you are being questioned. [/ QUOTE ] Nice level!! |

The initial reason he was arrested will always stick because of what you just stated. |

I've been arrested 3 times unfortunately. Been read my rights 0 times. Lawyer asks did they question you? No.. then they don't have to. edit: If they would have charged him with possession of a zip lock bag, then there may have been a case for this though. |

Re: Trip Report: Jail
[ QUOTE ]
10 minutes later he returns, asks me to step out, I abide and he immediately slaps on the cuffs telling me I have a warrant for my arrest. No rights read. [/ QUOTE ] The U.S. Supreme Court has declared that persons in state custody must be warned of their rights before being interrogated. Example 2: A police officer pulls you over for speeding and walks up to your car window. He sees a bag of marijuana in you lap. Without reading you your rights, he arrests you and you are charged with marijuana possession. Result: The charge is good. The officer didn’t have to read you your rights because he did not ask you any questions. |

Re: Trip Report: Jail
Ummm, were ever at any point read your rights? I dont know about the US but here in Canada not reading a suspect his/her rights before or IMEDIATELY following arrest is a major no-no and usually results in goodbye arrest.
