Yeah I'm not sure how a publicly posted picture being forwarded around it grounds for suing.
This guy is officially a troll for even thinking about suing.

If he can sue anybody, it DEFINITELY wouldn't be the boss. The boss did not take, publish, or search for the picture.
The picture taker can't be at fault - public place. The picture publisher COULD be at fault, but I hardly see how it would stand up in court. The guy who found the picture and forwarded it probably isn't at fault either. The picture was posted in a public profile for all to see. So, while I believe he has no case, if he does, it's against the picture publisher in Facebook.
