The answer is obvious: Who is a greater threat to public safety? The person who plans a murder or a person who accidentally kills someone? This is a no-brainer.

I agree with you, but it becomes a question of what you think the role of the justice system is. If it is to protect the populace, then your reasoning makes sense. If it is to thwart evil or punish bad people or whatever then the two crimes are equal, murder, and should be punished accordingly. Obviously I think this latter view is incorrect, but many people do hold it. You hear it come out when they talk about the sentencing of certain types of criminals.
