I really don't see how they can make him pay taxes on the ball if he derives no income from the ball. The IRS can't compute 35% of sentimental value.

I'm sure there's someone out there would pony up 1-2 million for this ball.....If i were that guy i put up a set prize of about 1 million, and if there was heavy demand for it at that prize i'd bump it to 1.5 and so on until only one person was willing to pay for it.

I agree, but that's not the law. If you receive a gift of land that produces no income you still have to pay tax on the value of the land. The painting example was also pretty good.
