Re: In divorce does 50/50 always apply?
"Are there taxes on gifts like this? I remember hearing there is a tax on any gift over $10,000 - not sure if this is correct."
I believe that a person is allowed to give up to $2,000,000 before the tax comes into play. |

Got ya - I mentioned this idea to him today and he basically said, "yeah, obviously, but unfortunetly her name is on all the houses, and my pension, so she would have to sign too." - So I guess that is out, unless there is a way around this.

Re: In divorce does 50/50 always apply?
Please, beg your dad to get the best divorce lawyer money can buy. If not for his sake, than for his sons'.
I'm not sure about NY, but in most states, you hire a PI and have them prove that she is cheating, which should be easy as cake in this situation. From what I understand, she will lose a lot when it comes to custody (I guess not an issue in this case), but more importantly monetarily. Hopefully a NY attorney can clear this up, but he should have his bases covered and hire a PI. PS Sorry your mom's a b. |

He needs to get her to agree to sell all the property. Tell her he wants a divorce and it will be easier to have lots of loose cash to pay her with, she'll def go for that. Then, he moves to greece with everything and never sees her again. the end.

Re: In divorce does 50/50 always apply?
I'm not saying she's entitled to 50% but just because she cheated doesn't mean she won't get it.
My guess is the judge would look at a few things like how long were they married, how far they've come since they got married (financially speaking) etc. She could make an argument that she raised the kids while he was out working and she's iven up so much. She miht say that she would have gone on to make millions had he not made her stay home etc. Even if she admits to cheating she could just say she did it because he was negelcting her etc. GL tho |

Re: In divorce does 50/50 always apply?
After reading that she has a masters degree I'm sure she'd tell the judge she was go on to make eleventy brazillion dollars etc.
But the idea of getting a PI might be a good idea. Even if it didn't help in the courtroom like the other poster said show her all the pics and negotiate down or else you'll show everyone in the free world what a biotch she is. |
