Default Re: Link to the judgment

[ QUOTE ]
They are not like the racehorse-owner, who has access to the trainers, the horses, the track conditions and other such insider information on which to base his wagers. Nor are they like seasoned card players or pool players who prey on unsuspecting, inexperienced opponents. Rather, they are more accurately described as compulsive gamblers, who are continually trying their luck at a game of chance.

[/ QUOTE ]

The judge explictly distinguishes the lucky lottery winners (flawed system or not) from those with inside information (race horse owners), and those with skill or predatory systems (seasoned card players and pool players).

It's ironic. CRA loses another case against gamblers and the judge puts another nail in the coffin for the professional card player.

But people don't want the truth. They'll just point to this case and argue that playing poker professionally is not taxable because it's gambling. Eventhough the judgement reads: beating the odds is not taxable and seasoned card and pool players are not of the same category.
