Oh whoa. She agrees over the internet to have sex with this dude and his friend for money. But then several men arrive, gang bang her unprotected at gun point, don’t pay her, and the judge says, “ it’s an occupational hazard.” She was not raped, but her property ( services )was stolen. Interesting.

I found this post quite interesting. Does no one wish to talk about it? At the very least, using this judge's logic, these fellows should also be charged with attempted murder, because they had sex with her ( forcibly ) without protection. Even if they all tested negative for HIV, gonorrhea, syphilis, etc., they inflicted unnecessary suffering on her by making her wonder if she were inflicted with one of these diseases or if she were pregnant. So in addition to armed robbery, certainly, some additional crime was committed against this woman, regardless of if she were a whore. If a thief broke into my property, held me at gun point, robbed me, then released a gas bomb, that caused my body incalculable damage, then the release of that gas bomb should certainly be a further serious crime committed against me, over and above armed robbery. Or perhaps the judge is correct in the criminal aspect of the case, and the woman should sue the culprits civilly for further damage.

I believe this would be assumption of risk in her chosen profession. I mean she advertises on Craigslist and goes to bad parts of town. Like I'm sure her regular customers will just pop a raincoat on...

Also, the guys who had sloppy 2nds, 3rds and 4ths assumed a risk of this nature too.

I'm pretty shocked by the judge's ruling. Where did theft of services come in. This is an illegal service. Only Vegas has legalized prostitution. So how do you prosecute for nonpayment of an illegal service.

However there was an assault possibly aggravated because when you threaten someone with bodily harm with a weapon that's the real crime.

You could probably break this down to aggravated assault by the first 2 people and aggravated assault/rape with the second 2 people. She didn't consent to sex with the second 2 they just showed up while she was under fear for her life. It would all depend on the state's legal definition of assault, but its common for states to define a threat as an assault, a weapon can make it aggravated, bodily contact is what makes it assault and battery.

Basically, the judge's ruling is crazy and probably morally biased. Possibly the lady's attorneys didn't make the right charges and correct argument on the charges. I'd like to see how the judge reacted to someone holding a gun on her in any situation. She might develop a whole new perspective on life.

This is stupid. How come she doesn't get to say no to the other guys after she's said yes to the first one?

It's probably just the judge's moral standard against prostitution.

Then again, I want to add that rape is way overrated. I mean, most people would much rather get shot (provided they survive) than getting raped, this is a ridiculous social pressure that we need to get rid off. So you got raped. Besides the chance that you got a STD, it's no big deal. It's stupid that we force people to believe getting raped is worse than having someone beat you to unconsciousness.

oh please what? you don't believe in evolution, or you fail to see how that could be developed through natural selection?

Here are my thoughts. In order to birth fit offspring, a woman has to be very selective with who they have sex with. This means that they have to be extremely protective of themselves. Having a terrible and seemingly disproportionately large emotional reaction to being raped seems a likely byproduct of that.
