Help recovering missing jpegs

Help!

Just got back from vacation with my gf and I had about half of the 400 pictures I took already on the CPU and half on the computer still. While transferring them I noticed that my favorite 5 pictures are missing now, I don't think I deleted them but maybe I overwrited them in my camera's program. I say this because I downloaded a data recovery program and the missing pictures aren't showing up in there (lots of other stuff) and I had to change picture names because duplicate numbers were showing up (so I wouldn't overwrite them). Is there any hope for saving my missing pics? I have them on myspace and they show up fine (thumbnail) but when you click on them it just shows a X and the picture is not there anymore. Really stressin on this should I give up the fight or is there anyway to save them for free?
