Default Passing a sobriety test

Sat. night I had around 10-11 drink between 9:30 and 1:00 while watching KU beat Florida at a sports bar. My buddies go to a strip club where I have probably 4-5 beers and a shot or two of rum.

At 3:30, we go home and one of my roommates convinces me we should go to the casino in Kansas City (about 45 min away). I had to drive because my buddy's license is suspended and he's bombed.

Now I got really dumb while driving and decided to go fast because there was no traffic. I get pulled over going 98 in a 70. The trooper comes to the passenger side window and asks for license, insurance. He says he smells alcohol and asks me if I had anything to drink... i say "not recently." My buddy then says "I think you smell it on me I've been drinking." Doesn't matter I have to get out for a sobriety test. Here's the tests he gave:

1. Follow light back and forth and then up and down without moving my head.
2. Stand on one foot and count up to 30 mississippis.
3. I have to lean my head back and close my eyes. He says "Start" and after I believe 30 seconds has passed I should say "Stop."

This was it and he said I passed and could get back in my car while he writes up my ticket (~$250). I have no doubt I was over the legal limit and was probably around .16 (I'm 5'10, 165).

In hindsight, I DEFINITELY wish I hadn't driven. I hadn't drove drunk for a few years until then. When I saw the cop pulling me over, my state of mind instantly changed and I had a rush of adrenaline. I was really lucky for something that could have been much much worse.


CLIFF NOTES: Had 15-17 drinks between 9:30 and 3:30am. Go pulled over at 4:15 going 28 over and passed a sobriety test, but received a $250 speeding ticket. Yes, I was a retard.

I don't understand why every cop on patrol can't have one of those things you blow into(alcometer or something) for situations such as this. I know I could do those things without necessarily be in any condition to drive a car.

Whether you were drunk or not, the tests are to determine if you are coherent enough to drive. He stopped you for speeding. If you passed the tests, which you sound like you did, the officer had no reason to suspect that you were a danger on the road - although you probably were.

As one post said about the breathalyzer (PBT), at least in Pennsylvania, they cannot be used to determine your blood alcohol level. You can use them to see if an underage person has been drinking, but not as evidence for a DUI.

If after passing the field test, I don't know what I would have done if he asked me to take a breathalyzer test. I believe I would have refused it and taken the fines they give you for refusing a breathalyzer.

I assume you are a police officer from your location?

How often or what portion of people pass field sobriety tests?

Mistake #1 Driving drunk (but you already know this)

Mistake #2 Telling the officer that you had been drinking earlier

Mistake #3 Actualy taking the field sobriety test

If your state is like mine then those fines include you losing your license for the period you would if you had taken and failed a test.
