PS: the question about if this guy was a regular should not be answered until the robbers are all caught. I know this is annoying, but its for the best. |

My read of the NY Post article is that they did not present it to the Grand Jury in time, and the likely reason for that is the weakness of the case at that time...I was there that night...a really sad day for all.

Your link no longer goes to a story that contains your quote. The story in the link does state that the alleged robber was involved in a manslaughter, not a murder, and that his parole was complete 10/12. Agree or disagree, he apparently is completely free of the criminal justice system at this point and has the same rights as a first offender. Good luck to the NYPD trying to tail this guy. If his only goal is to blow town, he can probably ditch a detective in any public building with an elevator and a bathroom. |

How does this warrant a "wtf?" they obv felt they didn't have a strong enough case. Maybe they made a mistake of picking him up in the first place--maybe some deal they thought they'd be able to negotiate after picking him up never materialized. Either way, they might have botched this a little but its not a loss.

Apparently the Grand Jury failed to indict this guy in a timely manner and he was released yesterday. Charges are still pending, but he can't be held without an indictment... Defense claims that charges are based solely on a single eye witness... Story also includes description of earlier murder conviction.
