If Hochevar doesn't sign with LAD by the deadline, is he a free agent, or does he go back in the draft?

Per the LA Times thru cnnsi.com:

Luke Hochevar, last year's college pitcher of the year at Tennessee, has impressed scouts in outings this month for the independent Fort Worth Cats. His agent, Scott Boras, says he believes he will get at least $4 million from another team, making an 11th-hour agreement with the Dodgers unlikely -- especially considering a contentious episode last September. In one whirlwind day, Hochevar dropped Boras, secured another agent, agreed to terms with the Dodgers, went back to Boras and backed out of the deal. -- Los Angeles Times

Stephen Drew was actually signed just before the draft. Hochevar wont be resigned. He will go to the Mariners in the 5th round.

see, I've heard rumors he goes #1 for lack of elite talent.

Sorry about that. I meant 5th pick not 5th round. There are a few arms better than Hochevar but yes there is a slight lack of talent.
