I would much rather keep $1000 on me and pay them that to leave if that meant I wouldn't have to shoot someone in the head. Maybe more, like $5k.

[/ QUOTE ]

I'd pay 1k to shoot someone in the head

Robber #2 was unarmed. I think the plan was for #2 to collect the wallets and [censored] while #1 kept the hostage pinned down. That's speculation; but either way it was poorly planned if the second guy wasn't armed.

[/ QUOTE ]

Not a bad plan as long as you have the ONLY gun at the party.

Your friend doesn’t play fair, he was supposed to be a good victim, hand his stuff over without a fight as the authorities recommend.

As far as giving a warning to an armed gunman pointing a gun at your guest’s head: good lord, WHY??? So he has time to squeeze one off on his way out?

I don’t think he has any legal requirement to give warning, he meeting deadly force with the same; I don’t know the law but I would drop him myself without warning.

Righteous shoot. I respect your friend.

Would the situation change if he only had used a toy gun? Wont be easy to see the difference in the stress of the situation.

I don't see what all the non-americans in this thread are getting worked up about??

Guy comes into mans house, pulls gun + takes hostage, owner blows robbers head off.

I'm American and this sounds fine to me, no jail time for owner is fine.

Why not shoot him and then gamble the money on the weight of his headless corpse?

Everyone's a winner...pretty much.

I'd shoot the guy without making a speech.

Also, shooting to wound is stupid. Dude has your friend on the ground with a gun to his head, this isn't the movies.

I can't believe your friend is not going to jail?!?
He killed the guy in cold blood. If the robber made a move with his gun or something it's ok, but he just stood there and mouthed off your friend and your friend just shot him dead. That seems wrong to me and looks like 2nd degree murder.
I'm not sure about American laws but i'm sure you would be in trouble in Canada if you shot someone dead like that.

[/ QUOTE ]

Don't know if any other posters have stated this, but its called Self Defense of the Third Person, it became a "law" in many states around 10 years ago. If you feel that anothers actions jeopardizes the life of someone and your only recourse is to end the life of the attacking party or cripple the attacking party by whatever means necessary you can be legally protected by the law from prosecution by the state.

This does not mean a civil case of wrongful death filed by parents or siblings would be dismissed however, it could still proceed all the way to a guilty verdict.
