OP just letting you know you that you might have a claim against McD's for
a) violation of your civil rights under the 1964 Civil Rights Act,
b) breach of contract, and
c)tortious extortion (this is where the monies is at). However im not your lawyer and this isn't legal advice, ymmv, etc.

overlay: Probly get that hornery pos fired too ldo.

Firstly, a business can set any rule it wants as it has the right to refuse service to you for any reason not deemed illegal - so it can say it wont allow you to openly disply cigs, but it cant say it wont allow you to be black.

For whatever reason, this situation arose and you could have simply dealt with it by complying, putting the cig away and moving on with your life. You chose not to do this and so were refused service point blank.

The customer service thing is not "the customer is always right", its "the customer is right provided he doesnt act like a dick". See earlier post, your just lucky they didnt just serve you a spit burger.

As for them not giving you a refund, im pretty sure thats illegal, but not 100%.

And as for the bar story children are allowed in bars, especially one like this one which is attached to a bowling alley full of families. If the law states a bar cant serve someone under 18 a none alcoholic drink, then this is the first and only time ive seen it in action.

Id lay a fair amount of money against you having a case for a violation of your civil rights since im 100% sure there would be none smoking signs up and there would be a sign clearly stating management can refuse service under their own discretion etc etc lawyerspeak.

They can deny you service maybe but not refuse to refund you for that... get that bitch fired and threaten a lawsuit to the regional miccy Ds = big macs 4 life

also, i think the laws vary depending where you live like kids under 18/21 arent allowed in after a certain hour and if that means coming for a soda, i think bowling alleys are uptight about ID

Yeah thats what I thought. The interesting thing is that she told me to put it away AFTER I ordered. Does that make a difference? Any lawyers on here?

I think what the guy said about they can deny you service at any time for any reason (unless it is something civil rights like you are a black gay jew) is right so when it happened doesn't matter

pretty sure they can't deny you service but still take your money. I doubt that is some McDs rule, just her making up her own rules.. so maybe she will get fired

honestly, its a case of breach of contract but it'd probably go to small claims court, however since its F*ing McDonalds I would totally pursue this, which can easily be done by findingh out the owner of that mcdonald's and speaking to them telling them of your complaint and your plans and just see what happens

I dont think taking your money then denying service is legal anywhere. I would think that's called stealing.
