If you are not under arrest by an officer, they can not detain you.

No. See Terry v. Ohio, 392 U.S. 1, 88 S. Ct. 1968 (1967).

I will obviously plead not guilty to assault. What about breach of peace charges? Thats such a [censored] charge anyways.

[/ QUOTE ]

How about asking Sen. Larry Craig? He thought pleading to disorderly conduct would make things go away. I doubt you'd get the publicity he got, but you'd still have a criminal record.

Cheers, Carl.

TJ, why the hell did you answer a call from some random number you didn't recognize right after this went down?

[/ QUOTE ]

They used his friend's phone to make the call?

There are distinctions in this case that do not make it applicable under the facts currently under discussion.

Wow, them taking the phone was way out of line, as was talking to them any more than "I do not know him, please cash me out now" and if that wasn't enough, "No you may not look at my phone, I would like to talk to my lawyer" (even if you don't have one). In this sort of situation you do not want to antagonize them, just be polite, firm, and don't let them intimidate you.

meet me at fox-woods. 1-2 NL rulz

ive seen numerous people all riled up getting the boot there. almost been in like 5 fights myself with drunken punks who run their mouth. its just cause ct sucks so bad that everyone releases their aggression, for having to live in this awful state, on others when they get all drunk. i bet in a month youd have no problem getting back in

I'm pretty much the snitch. My phone history and contacts mysterious erased right before questioning. My recent text messages however did not and the top one titled: "Come to my table" was particularly incriminating.

[/ QUOTE ]
Edit: Nevermind, you already explained why you snitched...
