Yup. In their custody. And they said nothing about responsibility. Nada, zilch, zero. Just f'n crickets. I called an attorney and my insurance company. It is just unbelievable that no one, especially the Owner , offered up some kind of apology or anything. My Keys trip is shot. Summer ruined and paying on 30 plus grand until this whole mess is sorted out.

if it was under their care, custody, and control then their insurance will pay for it.

Did you sign any waiver saying the repair shop wasn't responsible for theft/destruction/etc. while being repaired there?

If not, you should get at least reimbursed for the FMV of the boat itself since it was stolen while in their care. Either go after them via a lawsuit (which might cost you more in legal fees to be worth it) or insurance should pay for it.

blu,

Blessing in disguise. It's better to have friends that own a boat than to own a boat yourself. Find a friend who owns a boat, pretend you don't know how to operate one, get wasted while he drives, rinse, repeat. Spend the insurance money on golf lessons. When you get old you'll be happy you did.
