You aren't going to charge him with anything. The state is. Use a legal dictionary--this is absolutely battery. The individual acted in a way that intentionally or criminally negligently caused an unwanted, harmful touching to someone else. In many states, it would be aggravated battery, because of the inherent dangerousness of shattering the rack.

As for the comment about a personal injury lawyer, that's a completely separate issue, and the poster didn't say anything about suing the guy. Since you did, I'll let you know that you're wrong there, too. If the person hit with the shard was hurt (or damaged in any other way), he'd absolutely have a case against both the angry guy and the casino.

He didn't and it doesn't, but this was how he was identified. 'Angry Asian Guy' is a metaphor here representing any player that acts in this fashion.

Also, lol @ pressing charges and filing lawsuits... goodgrief I think you're just a TAD unrealistic about how the legal system works. Any prosecutor would laugh you out of his office, and filing civil suits because something hit you and did no damage is petty.

Which cardroom made this 14k settlement, BTW? If this is true I'm pretty sure there were other circumstances involved.

LOL at this. You may be right legally, but I don't really accept the concept that calling the police and suing the guy demonstrates my gigantic yarbles.

how about this...angry guy breaks rack...shard of plastic hits my face...nobody working for casino does anything...angry guy gets his head planted into the floor. problem solved!

Another reason I like playing at Canterbury. This guy would have been ejected the first time he threw his cards at the dealer.
