Don't think so.

I definitely think this still counts. The law could have won by keeping him locked up, but he got out of it.

Wait, I thought the good guys won at the end of 12 monkeys? Didn't it end with David Morse ending up on the plane sitting next to the bespectacled woman scientist, meaning they sent her back from the future to put a stop to the mad scientist (Morse)?

I don't think she was sent back to stop him, only to find a way to develop an antidote. I do not believe they wanted to change the past or else they would have just gone back 3 years earlier and run over Morse with a car.

Mhh, pretty much forgot about this scene. But she says "I'm the insurance" or something alike. So he might be right and this means the terrorists don't win.

I guess The Great Escape partially qualifies because most of them either get recaptured or killed.

Meh, I think it counts as an Allied win because of the sheer scale of the effort the Germans had to put in to recapture them (which was a big part of the reason they want to escape soo badly).

Kevin spacey does get Brad Pitt to shoot him (wrath as a sin) but he does get killed. so he wins but then he dies so not really.
