If AP is forced to produce those files, or face a very long-term prison sentence, I wouldn't be surprised if suddenly we get a response of 'unfortunately a rouge, ex-employee hacker has deleted our hard drive and thusly we are unable to retrieve the hand histories' followed by 'Ohhh, we forgot about something. There was a little hard drive stored up in John Doe's closet, which just happened to contain a backup of the backup of the backup that was lost. Phew!' [/ QUOTE ] FYP |

Re: My rebuttal to Mark Seif on RawVegas.TV
I saw both of the videos, and I wanted to give my impression. I don’t know any of the parties involved, and don’t have any inside information but I found the body language displayed by Todd and Mark very interesting.
My impression of Todd was that his body language and facial expressions were consistent with what he was saying. He nodded up & down when making a point, and he looked into the camera in a natural way. I can’t say what Todd said is true, but his body language strongly suggests he believes it’s true. I found Mark’s body language and eye movements very odd, especially when he was making an important point. When talking about AJ he nodded his head side to side (a “no” motion) and averted his eyes when he said that AJ was a nice guy and there was nothing extraordinary about him. Then when Mark said they certainly didn’t talk about seeing any hold cards, he let out an awkward laugh, and averted eye contact with the camera very strongly. On the plus side, Mark seemed to be nodding up and down (a “yes” motion) when he mentioned that Absolute Poker had hired an auditor and they erred on the side of over refunding the money. This may mean he is glad they are taking action, or it could mean that he is more comfortable because he has a positive point to make. He seemed at his most comfortable at the end when criticizing Todd, in a legalese sort of way. I can’t say if this is because he believed that Todd wasn’t telling the truth, or if he is more comfortable, as a lawyer, speaking in a more formal language than in the more direct, personal language at the start of the video. If I’m playing a poker hand against these two, my feeling is that Todd has a real hand and Mark is bluffing. Curious what other forum member’s impressions are. |

seif seems like a ticky sorta guy from his tv appearances to me, kinda like DN is. So while it does look like he is in fact bluffing, i personally don't wanna follow my read.

[ QUOTE ] You've got it backwards. The burden of proof is on AP at this point. They need to prove to us that there WASN'T cheating before all this, or we should assume that there was. You'd be a [censored] fool not to. [/ QUOTE ] This is exactly how it works in THE AMERICAN WAY. When you get an audit from the government for your suspicious tax reccords, it is up to YOU and only YOU to supply proper files in full. It is YOU who must make sure everything is legit, the reccords are correctly filed and up to date, and you did not try to defraud the government in any way. YOU get hit with tax evasion if you don't, it is as simple as that. YOU are under the heat and must prove your innocense to the max man, not the other way around. On the other hand, Mark Seif's THE AMERICAN WAY seems to have a much different meaning... But to his credit, he seems to be arguing about something different here. Anyhow, I don't doubt that the evidence has really been trashed and will never be seen again. Though on the other hand, if AP is forced to produce those files, or face a very long-term prison sentence, I wouldn't be surprised if suddenly we get a response of 'Ohhh, we forgot about something. There was a little hard drive stored up in John Doe's closet, which just happened to contain a backup of the backup that was lost. Phew!' [/ QUOTE ] Not trying to be a nit, but this isn't totally correct. While you must provide all information to the IRS, the burden of proof in civil cases is on the IRS, not you. The burden of proof changed in 1998. Regardless, it's up to Absolute to prove to the public that they are legit if they want to stay in business. |
