Default 3-5 commerce preflop weird action.

it's my third hand at the table I'm OTB. Villain has 1.5k stacks (200 max buy in) and UTG had about 200. I had 200.

UTG limps, UTG+1 limps, CO (villain) min raises to 10. He did something weird, like it made it 15 at first and toke five back. anyway, I pick up AQs and popped it to 40. UTG calls.

Villain announces raise and but just calls (lol?). some players not involved in the hand said it was binding and villain says, "okay. whatever... i'll raise if you want me to" the dealer said it's up to me. I have 160 behind as does UTG. villain covers.

what's my play? see a flop 3 handed or make him raise then stack off?

Live players are so bad i think its best to see a flop and if you hit a A or Q let him hand over his money.
