You know what I think. I would like to hear somebody try to justify the city taking it over and selling it.

The city doesn't own it now. If you mean 'justify the city taking it over in the 80's', a landlord who illegally rented out his old factory to tenants then abandoned the building (most likely, not paying any taxes, either) rather than spend money on fire safety. I don't see why that'd be a problem.

you are correct, the money and time put into the building by the tenants means nothing.

The tenants should have the right of use, but the building will be stolen from them.

If the former owner abandoned it, then I don't see who could possibly have a more legitimate claim to the building than the current residents.

A bank makes me a loan to buy a house. I buy the house, then rent it out to A, who sends me a check each month. I have no further contact with A or the house.

Ten years later, I default on my mortgage and walk away from the property. The bank forecloses and the renter gets an eviction notice, but doesn't comply with it because he claims cleaning it and fixing the boiler out of his own pocket makes it his house.

Who owns the house?

The main difference between this hypo and the OP is that 1)renting out the house was illegal in the first place, and 2)the landlord walked away (and presumably didn't pay taxes <---- city puts a lien on the property and takes it over) rather than fix the place up to comply with the amnesty law.

I understand yours, too, but this isn't even an AC thing. The city is essentially the same thing as a foreclosing bank here, so would you react differently if a bank took over?
