Not sure we can actually count 'The Empire Strikes Back' as it is, technically, just the middle part of a 3-act story.

As for other orig. thoughts of my own, I have none.

I'm surprised no one has mentioned Butch Cassidy & The Sundance Kid.
Tora! Tora! Tora! is kind of obvious from the start that the bad guys will win.
I think the bad guys win in The Spanish Prisoner, but I've yet to figure out anything about that movie.
One could argue the bad guys win in Brazil, but that's debateable.
The good guys lose in Breaker Morant, I suppose that's a bad guys winning.

Alrington Road is a good one until they make Alrighton Road 2: cul de sac bitch (in which case the son tries and gets revenge and could even be the bad guy of the film).
