In states where prostitution is illegal, could you instead have "porn taping sessions"? I'm wondering from either direction. Some John goes up to a street walker and asks her to be in his new porn video. Illegal or no? Some enterprising pimp opens a new 24 hour porn production company that is nothing but a whorehouse that has open casting and charges a nominal fee. I realize this is blatantly still prostitution, but would it actually be illegal? I assume there would be some sort of license that one would need to buy...

No, as I mentioned earlier in this thread, having sex for money is prostitution whether it is filmed or not. Pornstars are technically engaging in prostitution, but they can't be prosecuted unless the act (of accepting the money, not the sex) is witnessed by a police officer.

California v. Freeman says porn is legal in CA. As long as you don't pay someone for the express purpose of having sex with you/someone else, you're making a film which is covered under 1st Amendment

Swing, it'd be illegal to go up to the street walker since you're doing it just for the sex as a work around. The pimp is kind of a gray area, if he's selling the tapes and getting releases and licenses it might work in states where filming porn is okay.

I believe this case covers the creation of pornography and not acting in pornography. It only covers pandering offenses, not prostitution.

Someone who is creating a video of people having sex is engaged in an activity protected by the 1st Amendment. But I don't think someone having sex is protected by the first amendment just because they happen to be filming.

If an actor or actress was being paid, the case would probably hinge on what they were actually being paid for. The actor might make the same type claim that an "escort" would (the escort is paid for their company, not for sex). They could say they were being paid for the non-sex parts of their job, for example. I have no idea what porn contracts look like, so I don't know if this would be credible. It is also likely that the pornography in the case cited above had a lot more non-sexual, "artistic" content than more recent porn does, and this might make a difference.

On the subject of enforcement, if I film a murder, and the police get the tape, the murderer will be prosecuted. If I film someone smoking marijuana, and the police get the tape, the smoker will not be prosecuted because such a misdemeanor can only be prosecuted if an officer witness the crime. I believe run-of-the-mill prostitution falls into the latter category.

Might be looking at some older stuff, she has def been pornified, veneers, nose job etc. She was a solid 9.25-9.5 the night we hung out, was dressed very well too. She really didn't look like a hooker that night.
