Yes but the punishment for your scenario is obviously going to be much much less than someone who actually shoots the gun yet fails to kill the person, or is holding the person at gunpoint and hasn't shot yet when they get arrested.

How is that poll not in SMP? Who wouldn't want to see 2,000-word diatribes on whether mansluaghter or corpse-screwing is the lesser evil? Wouldn't you also want the SMP SuperFriends answer as to how many corpses each would screw if it would prevent the death of someone they loved?
