If he died before any civil proceeding, I'm fairly sure the estate can only be liable for compensatory damages, and not punitive damages.

But I am not a lawyer, etc...

So sending them to jail won't get my friends' pension and health insurance back? Awww, shucks. I guess it's good that it's so rare that people lie and cheat to make themselves rich. The poor folk can take it on the chin just this once.

You wise and happy slaves to the almighty dollar you assume is in your pocket because they tell you it's there and because you have "choice". A dollar in your pocket is good, right? Choice is good, right? Yeah, good words so it must be good policy and nothing to do with legalised theft. Why would the rich need to steal? Oh, wait...

You said your friend wasn't worried about his pension, only his health insurance. What did he lose, a few months of health coverage?
