Whatever the IRS law, if Congressmen are on the floor condemning an ad in a newspaper, they are condemning free speech. Just because the law already restricts free speech does not mean the concept of free speech all of a sudden doesn't exist. The Constitutional reference merely shows that the right of free speech is acknowledged by our government. That reference doesn't mean that that right is respected in practice.

You didn't answer the question asked. You answered some other question.

The question was "Does a 501(c)(3) organization have free political speech?"

Such a group of people certainly have a *right* to speech. But the law as stands violates that right. Their speech is NOT FREE.

Think real hard why its a bad idea to give political organizations any tax benefits at all which can be taken away if they get out of line.

Yes they do.

501(c)(3) is a section of the Tax Code that covers charitable, educational, religious, etc organizations. These entities have to file for this status and must disclose to anyone inquiring what their status is. Donations to 501(c)(3) groups are tax deductible

I'll take you through it in easy steps.

moveon.org organizes as a not-for-profit.
a requirement of not-for profits is that they don't get involved in politics or make political contributions.
moveon.org wants to put a political ad in the NYT.
they have a choice...don't place the ad, or retract their not-for-profit status.

Even that doesnt get them totally out of the clear if they want to support a particular political party, because of contribution limits and it will also be interesting to see if they try to violate McCain Feingold. Id love to see Sorass [sic] take it up the butt with a huge fine.

Okay that clears it up thanks. Now I see what you were getting at. Didn't realize moveon.org was unique in being a non-profit engaged in politics. Now that you've taken the time to enlighten me, I agree with your posts. Looks like we were agreeing in our takes on politcial orgs and taxes. after all. Sorry for being a moron.
