I'm pretty sure it's not illegal to have these programs on your PC, since most serious BG players have them.

It has always sounded like they scan things like the window titles and the executable filenames associated with currently running processes on your computer. They don't appear to scan your hard drives (which would find bookmarks, browsing history, and cookies if your browser doesn't encrypt them) or the registry. I suspect they're reluctant to do anything that would set off tons of virus/trojan/malware alarms from security software.
