guids, the class of crime below misdemeanor is called a violation [/ QUOTE ] In California it is called an "infraction". Regardless, you can be "arrested", meaning the police officer can detain you, Terry search you, collect evidence, etc. However, OP was a moron for submitting to a breathalyzer test if he was not driving. If you submit to a breath, blood, or urine test you are just giving evidence to the police. Read: http://www.YouAndThePolice.com AB |

[ QUOTE ] I'm guessing there's more to this story that you aren't telling us, but even if there isn't it doesn't matter, you're screwed. [/ QUOTE ] Yes. What Klompy means is don't be a stupid drunk dick to cops. Especially when you are underage. Cooperate, apologize, and then go home. [/ QUOTE ] I honestly was not an [censored] until after he had given me the citation at which point I thanked him for getting a hard hitting criminal off the streets, he then gave me the option of spending the night in a cell I told him I’d take a rain check on that. But apparently none of you have ever ran into cops with some type of grudge against the world, well anyway they exist. |

I think you should have posted this in that BBV section, I'm sure you might have found a few knuckleheads who are sympathetic to your plight. I'm assuming the majority in the this section are only sorry the cop didn't take the nightstick to ya.
Personally, I hope they give you the max. You should have run back to pick up the litter and apologized for being dumb. Probably would have let you go. Believe it or not, they have better things to do too. And no, amazingly enough, I've never run into any cops with some type of grudge against the world. And if I ever do, I'll be damn sure not be breaking any laws and even more damn sure I don't break his balls. |

The tool DID post this in BBV:
http://forumserver.twoplustwo.com/showfl...part=1&vc=1 And now he's messing up the fine posts presented here on the OOT forum - the forum of dignity, respect, and completely literate discourse. It's a shame - a complete shame - that our fine OOT forum is littered with such pusillanimous nonsense. Much less a cross post in clear violation of the charter of the OOT. May I submit, in all humbleness, that OP posted this thread in violation of these well drafted rules - rules that are here for our protection and safety; rules intended to allow the offenders to be drawn and quartered. Painfully.: -Cross-posting for no good reason. Your thread didn’t get any traffic in the other forums? Maybe that’s because it was stupid, or because the other forums get less traffic than OOT. This is not an excuse. -Asking OOT questions that you’re too lazy or dumb to answer for yourself. -Stupid advice threads. These are even worse when they’re in the wrong forum, or when you need to make a gimmick account to start the thread. AB |

Interestingly, I came across this topic in a class I'm taking this week. The case that's related to this is Whren v. United States, 517 U.S. 806, 813 (1996).
Look it up at findlaw.com. Long story short, pretextual detentions for traffic violations are legal. -bb. |
