Here's the big question, how long ago was the arrest? And where do you live state wise?

I currently work in private sector security and I can tell you that generally anything over 5-7 years is pretty hard to find. It depends on if it was in the same state, which type of background check they do, etc.

Your problem will come in if the hiring agency guy decides to tell him.

I got my current job which requires DOD secret clearance with a misdemeanor conviction. Generally during the second interview or something I say "Hey, I just want to be clear, if you do a background check you might get a hit on blah blah blah." I generally then explain what happened downplaying it of course.

I would probably tell him because the agency will to cover their liability, but just do it causal and imply that it was sealed or "suspended" because most background checks have to be thoroughly looked at to find a conviction ruling.

Update: Many of you were right. My record came back completely clean which is a relief. Still I think I made the right decision
