Sorry, show me where the T&C's say that I won't be paid if I have moved (and thus have a new address) since signing up (or since last getting a new driver's license)?

That's funny. When you speak to your lawyer about the bill, ask him if that silly clause will live up in court. I promise you it will not. The funniest part is that it clearly says nothing about CCU not having to pay if updated addresses aren't sent promptly. I lived up to my contractual duties and you have not. My information is accurate and truthful. I'm telling you, in all honesty, that clause does not get you out of your contractual duties. It would even lead to further legal claims, those being 93A claims, for unfair business practices. Those come with treble damages. Here, look for yourself. I will ask you once to reconsider the foolish decision you are making.

[/ QUOTE ]

FON, you are in danger of losing support from the more chilled guys here. Yes, some people are upset because they are clearly gnoming or underage. Hard luck on them. But don't try to weedle out of your obligations to the legitimate claimers on a technicality.

I'm not a US lawyer, but US contractual law is not that different from the UK. OK you have the right to ask for ID and not informing you of changes is a breach BUT that in itself does not negate the contract in it's entirety and give you the right to waltz into the sunset with the money.

As previously stated, if I am able to recover commissions for leads generated this month...all processing claims will certainly be paid (assuming it is decided that doing so would not be in breach of the new Unlawful Internet Gambling Enforcement Act). Perhaps helping me recover the commissions would be more beneficial than trying to do whatever you can to ruin my life?

Jibba - I'm assuming the response from SIA means that the broker was paid for the lead(s). This is good news. However, please note that I *DO NOT* have a direct agreement with Sports Interaction and therefore have not discussed the issue with them.

If you all could allow until the 20th before filing suit or taking whatever action you feel necessary, this would certainly give me the time to a) verify that the broker was in fact paid for the leads, and b) verify that I would not be in breach of the Unlawful Internet Gambling Enforcement Act by sending payments.

Thank you specifically to chopstix being what seems to be the only one here more interested in getting things sorted out than some of the other things being elluded to.

Stalling & smokescreen tactics. I hope you guys can see through it. Most likely FON will also pay out the debts to the most vocal complainers in this forum, use several excuses for the majority, and hope the problem goes away without a lawsuit and he gets to keep say 90% of the stolen money. That could happen.

I have to say I think people like chopstick are being naive and doing more harm than helping the issue, but of course that's only my personal opinion.

In the real world very little is black and white. We may all have our views on what is fair and what FON deserves, but discussing the matter calmly (like the adults some of us are ) is most likely going to get the best result - which may not of course be everyone geting all their owed money - but that's life.

I think there's a fair chance that without Chopstick's reconciliatory approach FON would be well gone by now. Wait for a few days and see what happens. If you have a legitimate case and are not paid then, by all means take whatever action you feel appropriate.

Here is my CCU experience....

August 28, 2006, 12:38 am

Question: Hello, On 8/26 i signed up for my first site which was Sports Interaction. I downloaded thru your link. Signed up. Made a $500+ wager thru SIA. Anything else I need to do for you? Form to fill out or anything?

Answer: Thank you for your interest in CasinoCashUnlimited.com. You will need to click the "I Have Completed This Offer" button below the Sports Interaction offer description. Other than that, you're all set! Thank you.

September 26, 2006, 1:29 am

Question: Sheldon, Let my apoligize first if you have already replied to a email I sent earlier on Monday. I've recieved 3 emails in 3 days from my ISP. I want to strangle them at this point. I wanted to get an update as far as if the SIA check had been mailed yet. When I log in here it says processing. My understanding was that the check would be mailed last monday. Thanks Terry

Answer: Actually, strangely enough, your check was received yesterday marked "Return to Sender." Could you please verify that your address on-file is correct so that we can resend your check? Thank you for your cooperation, I apologize for any inconvenience

September 26, 2006, 11:19 am

Question: Sheldon, My info is correct.I have Neteller as well, if you wanna transfer it that way as well. Terry

Answer: Either is fine (though NETeller is more convenient on my end), whichever you prefer. Let me know and I\'ll get payment out as soon as possible. Thanks again.

October 2, 2006, 11:02 pm

Question: Sheldon, Could you please give me a time table for when I can look forward to the SIA payment hitting my neteller account. We had previously discussed. It has now been about 7 days since our last email conversation

Answer: I apologize for the delay! Because payment is being sent at an irregular date, we\'re waiting for an EFT to clear. Your payment will be sent shortly. Thank you.

Soooo, you see.... I was supposeded to be paid last month.
Due to a "strange" occurance my check didn't make it to my
residence of 7 years. LOL. And I'm still waiting on that
big EFT so I can get paid in Neteller. Why would you need a
EFT, if the supposed check was valid ?

Care to explain this away FON ? Just for the entertainment
value ? Or is that CON ?

24 Hours with FON

i just think this guy is a riot and put together a few quotes from his posts and his 360 degree turn in under 24 hours.

this will be posted in the moster thread as well.

this is funny stuff..........

------------------
10/09/06 11:23 PM
While I do empathize with those of you who feel CasinoCashUnlimited.com owes you something, there is simply nothing I can do. I have not and will not receive commission for leads generated in the month of September

10/10/06 12:37 PM
If you all could allow until the 20th before filing suit or taking whatever action you feel necessary, this would certainly give me the time to a) verify that the broker was in fact paid for the leads,

10/10/06 01:31 PM
No, I wasn't going to attempt to recover commissions as I was told the lead quality was unacceptable. As far as the curb-stomping...one day you'll realize that not every webmaster is a pimple-faced pencil-neck

10/10/06 01:37 PM
Right now I'm just trying to verify that the broker was actually paid, which shouldn't be very difficult. If he was...I don't think I'll have any problem recovering my September commission.

10/10/06 01:59 PM
If someone was good enough to get my home address, I regret to inform him or her that the address they found is not where I live...there is absolutely no record of my current residence ANYWHERE

10/10/06 03:48 PM
So, would you rather stew over what my intent may or may not have been at that time...or take assurance in what my intent is now?

10/10/06 05:15 PM
Payments for Sports Interaction completions will be made assuming that a) Commission is received, and b) It is decided that doing so will not be in breach of Title VIII. International members will be paid regardless of (b).

I'm requesting verification documents because it has come to my attention that many of the Sports Interaction completions were/are "gnomes."

10/10/06 05:28 PM
OK, but I'm sure someone here will be able to explain to you that my actions represent a good-faith effort to meet my obligations as those providing the necessary verification

10/10/06 06:35 PM
Take a look at some of the things they're saying to me...CasinoCashUnlimited.com will remain closed after this whole ordeal is sorted out; I have no reason to be polite to people who want to "curb stomp" me "even if [I pay]".

lol.... the best one yet, things sure did turn around in a hurry
10/10/06 06:59 PM
At this point, I'm getting every indication that I will receive the commissions - I'm just waiting on the final word on if and when payment will be sent. It looks to me that miscommunication somewhere "up the ladder" is to blame. I should have a more concrete answer during business hours tomorrow.

10/10/06 08:21 PM
Good one on the triple post. I can see that you're not going to give up, and since you're a lawyer (heh?), go ahead and file suit. I'll pay everyone else, and I'll deal with you personally

10/10/06 08:31 PM
I'm done posting here...as of now I've not broken any laws

Further, do you think the Speaker of the Assembly has some exclusive right to that name?

10/10/06 10:17 PM
If your account/completions is/are unique and legitimate, and you have not violated our Terms & Conditions, you have nothing to worry about. Thank you.

People - The terms for the September signups are that we will be paid on or prior to Oct.20. It is now Oct.11. He has until Oct.21 to render payment, per the terms that we all signed up under. If for some reason he doesn't, we can address it then. Until then, it's pointless to wring your hands, because you have all agreed that he has no obligation to pay you until Oct.20.

Sit back, pour yourself a tall one, and chill. If Oct.20 passes and he hasn't paid, then pursue whatever action you feel necessary. Until then, give him a chance to pay by the timeframe you have already agreed to give him when you signed up.

To those who are concerned about him being a scoundrel: If you are right, he's not going anywhere, and he won't get away. Too many people know exactly who he is. I think he has a much better understanding now of the impact of his decisions, and he is taking action to correct them. Give him the chance. If he doesn't, you can always act later. Being hostile now does nothing to improve the situation - it only makes it worse.

Anyone in the D.C. area? PM me and I'll buy you a drink to calm your nerves in the meantime.

[/ QUOTE ]

I have no problem waiting until the 21st now that he's backpedaling. However, if he doesn't pay in full by the 20th, then i'm filing.

Btw, a lawsuit isn't meant so much to get the money out of him as it is to start proceedings so that we can subpoena his bookkeeping records. I'm willing to bet he's defrauded hundreds of previous clients by telling them that "the casino didn't pay me". I smell lots of legal trouble in his future if this is true.

I am not a subscriber to this affiliate, but the thread was pure gold!

Just a suggestion. If he wants driver's licenses from everyone before paying, why not ask him to do the same. I am sure he would not mind verifying his identity to you all, right?

If I had signed up with CCU I'd try to find a hedge to offest your risk. I think Bodog has the odds right now.

CCU paying people ...
+5800000000000000

CCU stiffing people ...
-9999999999999999999999999999999999999999999999999

So you only have to lay down about 10^8 billion and you're hedged on your $250.

It is not these school officials problem or the politician's problem.

[/ QUOTE ]

I'd like to respectfully disagree with you here PA. If someone were fraudulently using your name for something illegal wouldn't you want to know? If someone used your info to get a credit card would you just say "meh, not my problem?"

As for it not being the school's problem, here is an excerpt from
"the Fisher Creed"
[ QUOTE ]
The Fisher Creed is a statement conceived and written entirely by Fisher students, and it speaks to the basic values and aspirations of the students at St. John Fisher College.

As students who have chosen to join the St. John Fisher College community, we share certain basic values and aspirations.

In order to be active participants in a shared living/learning experience, we bring to Fisher:

RESPECT
for ourselves; for others, their ideas and beliefs; and for our community as a whole.

OPEN-MINDEDNESS
to things that are new, different, and unfamiliar.

INTEGRITY
that will enable us to be honest, sincere, and true to ourselves.

By bringing these qualities to our mutual experience, we help build a community that exemplifies the following values:

RESPONSIBILITY
for individual actions and for their impact on others, and for creating accountability by community members.

LEADERSHIP
in an environment that fosters active engagement in our community, displayed through participation, mentorship, and service.

[/ QUOTE ]

If he used school servers to access and facilitate a fraudulent and possibly criminal enterprise, he has exposed the school to potential legal problems and possibly tarnished their reputation. I believe situations like this often result in expulsion for the student.

That said, I think FON is doing the right thing by posting here and trying to set things right. However, I still have not received any email notification from him about this issue, so I would guess that he is likely to stiff a lot of other customers who don't read this forum. I'm waiting until the 20th since that was when I expected to get paid. After that, he's fair game if he doesn't come through.

Yes, i agree that it is the school and the politician's business, but since PA is the mod here, i will follow his wishes and not post the emails again on this forum.

Not to worry though, as the school's president, VP, etc, Assemblyman Silver, McDonald's, and the NY FBI's office have all been duly notified.

Some people have PMed me asking why i'm being such a pitbull about this (the vast majority of PMs i've received are more along the lines of "get that bastard!"), and this is my reasoning. FON has clearly made an attempt to defraud us. Even if he pays us, there are still probably hundreds of people he's done the same to who don't happen to read this forum and will never get paid because they didn't complain. My goal is to see FON pay one way or the other. You may not agree with my reasoning, and that's fine. You get paid your way, and i'll get paid my way.

cheers~
