Re: A very difficult roommate situation
[ QUOTE ]
Unless it's written into the lease, this $100/day thing is complete BS, especially if they have no proof of how long he's been there. What if they said they were charging $1000/day? Again, unless it's in the lease, they can't just set an arbitrary number here and expect you to pay up. Granted, they can evict your asses, but that's different. [/ QUOTE ] QFT And can't you just deny this? How would they prove it? |

Re: A very difficult roommate situation
Bob,
Thanks. I suspected that may be the case when you mentioned that Joe didn't leave but was rarely there. So I guess my question is, shouldn't they have to prove that Joe is ALSO there? Can't Joe just say he moved in with his girlfriend at the time, since he would be the harder one to prove residence for? Or does the fact that there is no paper trail render this argument toothless? |

Re: A very difficult roommate situation
SUB,
Dude leaves. Joe tells them he was a friend visiting for four days. Ask girl if she snitched. If she did, kill her. If there are any fines, Joe and friend split them. |

[/ QUOTE ] Toothless. When you sublet, you have notify the owners that you are doing so. You sign paperwork and so on. Joe did not do that. He just had his friend stay over. Although Joe was practically living at his girlfriend's apartment within the same complex during this time, his legal place of temporary residence was this apartment (his stuff is still here). So according to the apartment owners, he is still living here regardless of where he is staying. |

Re: A very difficult roommate situation
Bob,
W/r/t the people being millionaires, that's just amazing to me. Seriously, how can they enforce this stuff? One of two solutions seem obvious: 1) Subletter (sp) signs contract, so there is a paper trail, in which case Joe was just a visitor 2) No paper trail, in which case subletter was just a visitor I mean seriously, let's say I visit you for a week because I want to get a feel for bumfuck Pennsylvania in the summertime. Are you on the hook for $700 because I crashed on your couch? |

Re: A very difficult roommate situation
Kick friend out.
Tell landlord you were unaware and that friend is gone now. Refuse to pay any back fines. Tell them to take you to court if they insist. Have lengthy battle in the court until graduation. Graduate and move out. |
