I think the tow-truck and driver MIGHT be the only legitimate sue-worthy individuals here if the tow-truck was parked in a really stupid area such as on the other side of a curve and in the fast-lane or something.

There are dangerous ways for that tow-truck guy to be parked imo where perhaps they could have done a better job.
Having lights that work isn't an excuse to just set up wherever you want imo.

However, if the car happened to stall right there then I don't see how there was much the tow-truck driver could have done.

But I've passed tow-trucks and cops who were set-up in lanes where you just couldn't see them until kind of late and I have frequently thought, "WTF are they doing? They're making things way more dangerous for everybody."


I'm guessing this is as stupidly frivilous as we all imagine it to be.
Especially considering his drinking and use of cell-phone, etc etc.
Just saying I believe there are scenarios where the guy who was parked should have some of the blame.

The section of the road where it happened is straight. It's not easy to see the crash, but the stopped cars are obvious as hell on the road in this video.

BTW, if you do a search on the lawyer he comes up as a TAX lawyer in Tupelo. Clearly out of his league, there were plenty of ambulance chasing firms that could have made him not look like a fool.

This has to be the auto manufacturer's fault. Good little Josh was always safe. It must have been defective and come loose at impact.
