You weren't just assaulted, you were also battered, which is what I think you probably mean by you're gonna make him flip burgers for you. Assault is defined as him putting you *in apprehension of imminent physical contact*, battery is him actually making unwanted contact (with your lip). So say he hits you on the back of the head when you don't see it's coming, there's no assault. Obviously depends on where you live, but you're probably not getting too much money for this fight, I'm not really sure you'd need to talk to your lawyer.

edit: Also, you don't tell us when you used a bad name for a black guy, or what it was. Also, although you probbaly could have handled it better, i'd say on a scale of 1-10, 10 being ghandi, you get like a 7.

I don't think he's worried about legal ramifications, but losing his job. E.g. it's much easier to explain to your boss, "my ex's crazy boyfriend just came into my office and attacked me, I'm sorry this happened" than "my ex's crazy boyfriend just came into my office AND I WAS ALL LIKE, 'FK YEAH, LET'S DO THIS!!' sorry the entire office was destroyed by our fight"

LOL at OP who thinks anything will come of a simple assault charge. The charges often get dropped, or at most he will have to pay a fine assuming hes not on probation.

So many Beats here:

You got hit in the face.
The people in your office think you are a racist.
Calling the cops after getting hit in the face.
You work in a cubicle, and are afraid of losing said cubicle job.

OP you shoulda just kicked his ass once he hit you first, that one dude is correct, you can defend yourself...if you lost your job over kickin his ass, you could probably sue him over that since he was the cause

OP can definitely civilly sue for assault and battery...just get some attorney who works on a contingency basis, the guy who fought you will prolly wind up having to pay you (prolly not much) but he will also have to pay his lawyer too, so you are kind of getting him in two ways by doing this and you get free monies

oh and by not fighting back, you may get more money...since the whole point of tort law is to maintain a civil society by punishing wrong doers and not make people solve their problem on their own (violence)
