LOL at OP who thinks anything will come of a simple assault charge. The charges often get dropped, or at most he will have to pay a fine assuming hes not on probation.

[/ QUOTE ] OP you shoulda just kicked his ass once he hit you first, that one dude is correct, you can defend yourself...if you lost your job over kickin his ass, you could probably sue him over that since he was the cause OP can definitely civilly sue for assault and battery...just get some attorney who works on a contingency basis, the guy who fought you will prolly wind up having to pay you (prolly not much) but he will also have to pay his lawyer too, so you are kind of getting him in two ways by doing this and you get free monies |

oh and by not fighting back, you may get more money...since the whole point of tort law is to maintain a civil society by punishing wrong doers and not make people solve their problem on their own (violence)
