I should probably also add that getting both of us evicted from our house would do some damage since the movers would set him back about 1000, any eviction tips?

Get transvestite hookers to knock on landlords door at 3 am. Have them ask for your roommate.

"Hello, police? Yeah, me and my friend had some hookers over and he didn't pay attention as the hooker took the money from my wallet. I want you to come here and arrest him."

That might turn into the best trip report ever.

[/ QUOTE ]

That undoubtedly would, but from the way I read the OP, the friend stole from OP, then the hookers stole from the friend. If the "friend" actually stole from OP, what happened to the money after that is actually irrelevent to the theft.

True but wouldn't something like just be my word against his with absolutely no proof or witnesses? Something like that can't hold up in small claims.

He stole your money. Why don't you have legal recourse?

take $2100 worth of his stuff (electronics etc...) and sell it to get $$$ back

and btw, he's not your friend

and one last thing 85% of $2100 = $1785 so he can't do math either

This was the first thing I considered but if I did anything obvious like that he would just take it out of my rakeb. each month until it's paid off.

The proof would be him admitting that he stole your money. Record him admitting to it then file a complaint. I'm sure he will pay up long before you get to court. That and either move out or have him move out, don't live with a person who steals large sums of money from you.

Wow you couldn't be troubled to finish typing "rakeback" when you were just three letters away?

Please DO type up this trip report. One of the more confusing aspects is how you're not pissed that he "took" $2100 from your wallet. Did he ask you or did you find out later? Why are you leaving a wallet with $2100+ sitting around, etc...

He agrees that he should pay 85%. Would you be happy if you could get that much out of him? If so, start busting his chops about it.
