Yeah, hes smart enough to know better than to go kick the guys ass and end up being the one who gets in trouble. The problems is the girl doesn't want to press charges. Pressuring her about it doesn't seem like a good choice, so if she doesn't come to her sences what can he do that won't end up getting himself arrested.

This is incorrect. The hospital will do a rape test while she's there, they will have his DNA if it is present and there are witnesses that can support the fact that she was too drunk to consent. Therefore if his DNA is present it's a slamdunk conviction.

Assuming this was being done since they went to the hospital for STD or whatever testing. That's why I said it should be first. I don't know how well one can clean the area or how long semen/residue stays alive/detectable since I'm not a doctor.

Funny story, at ~26, I carried my ~22 year old sister out of a bar over the shoulder cause she had a few too many when visiting. No one said [censored], even multiple cops we passed on the way. I was a little surprised but expect they see it often.
