It never got that far. The insurance companies had their investigation (which was pretty much just talking to the parties involved, none of which had police reports filed), reported back their findings to me and the other party and then asked if we wanted to continue. All 3 times I contacted the other party and made deals and we'd cancel our claims then.

I don't think any of them were truly lying. I think they believed that they didn't cut me off, whether not seeing me or what. All 3 were SUV's vs my little POS. None were any serious... just minor bumper dents & paint chipped.

Of course I lived in a not so well off area so when someone could get their bumper fixed from insurance or get $300 hand money from me to forget about it, I guess it made their choice easy.

I rear-ended someone at about 55mph. After going through the courts, I was in absolutely no fault whatsoever. The other driver blew a .22 after the accident.

So, in summary, you aren't informed when it comes to traffic law. Surprise!

OP,

If this incident will have a significant effect on your life, get a lawyer. Don't listen to IggyWH, me, or anyone else here without knowing and vetting their credentials.

It is CORRECT to not move someone after such an incident without first strapping them to a board to immobilize their spine. You may have noticed the board the paramedics had to strap him to?

Your insurance companies didn't try to fight it? I would assume they had lawyers looking into it - did they tell you that you had no chance of winning or what? Otherwise I don't see why you are taking such a strong chance that the rear ender has to be at fault.

Or they could get nothing b/c you said there was no police report, at which point when they make their claim in court your insurance company goes, "Oh yeah? Prove it" and that's the end of the trial.

Did you have any witnesses?? I think that's the only way you can prove you were cut off.

I rear ended a guy almost a year ago and was not found at fault, only because he was backing up. Completely different situation, but you can rear end a person and not be found liable.

BTW, I did have a witness.
