The problem is many, many people at any particular time are not driving as well as they could be. Being tired, having just had an argument with the wife, dealing with losing a friend or loved one, eating, or driving with crappy brakes are all legal. People who don't drive well most of the time include teenagers, the elderly, people with moderate vision problems, people with narcolepsy, etc. All of these people will not drive well compared to a middle-aged well rested control subject. Hell, even having a cold is life threatening if you have to sneeze. Where do you draw the line? Millions of people are impaired in some way. |

The sad thing is that a number matters and not your physical state. This is stupid. I can't judge whether or not BB was impaired through a post, but passing the field tests should be enough IMO.

[/ QUOTE ] If the basis is preventing accidents shouldn't the penalty for the following offenses match drunk driving: 1. Talking on a cell phone (similar impairment per studies) 2. Having a tire blowout on the highway. You lose control of your vehicle and become a hazard. You should have prevented this by maintaining your vehicle. 3. Running out of gas on the highway. Your car stops in the middle of 3 lanes of traffic. Again you are an extreme hazard and your actions have caused it. |
