OK not to hijack this thread but I keep hearing all this advice about "not blowing" and "don't take the field sobriety test." I thought if you refused this they automatically arrested you and took you to lock up where you took a forced breathalizer or blood test. I've also heard they can suspend your license for refusing said tests (though this sounds like BS to me).
Anyone want to give a go-to standard procedure for what should be done should you get pulled over with a few drinks in you? For the record, I ask not because I drive drunk, but I have no problem driving with 3-5 beers in me, which does not substantially affect my driving ability (I'm not putting anyone in danger), but on the off chance I get pulled over I could blow over the limit (.08 in my state). |

1) Never blow. [/ QUOTE ] We've been over this before. In most states not blowing equals a suspension of your license. Moreover, the police will just arrest you and extract a blood sample. So if you are actually intoxicated, you will get busted regardless. Refusing to blow just guarantees that you will lose your license, even when you would have blown below a .08. The better play is to blow, and if it is over .08, demand a blood test. Since breathalyzers are innacurate, there is a chance that you could blow over a .08 when your BAC is actually lower than .08. And if you do things this way, you don't lose your license. |

Why were you driving while impaired?
Did you think that it was alright to risk the lives of others so as not to inconvenience yourself? Please respond. You made a "conscious" decision to drive while impaired, risking your own life, but much more importantly, the lives of innocent others. I would really like to know how you justify this selfish, irresponsible act. |

Since I think you're an idiot for doing this in the first place, I think you should show up to court drunk and yell out "I'm innocent! Case dismissed!"

It pains me to read about this when the solution is so simple. Next time you decide to drink and drive it is essential that you have a mickey in your glove compartment. When pulled over turn off the car and proceed to chug the booze in plain sight of the officer. This will exempt you from any sort of DWI charges.
