most/many floors will actually push the pot to the guy who mucked as long as it can be confirmed that he actually flashed the ace (by the dealer or the overhead cameras depending on how strict the casino). i have seen multiple casinos do this. i think its the right thing to do despite not being technically correct. the guy who the floor decides lost the pot never puts up a fight of course because you would have to be a ridiculous jackass in order to do so (of course the pots i have seen were in limit games).

once the pot is pushed to you, you are in a really bad spot. i honestly would give the guy SOMETHING back at least. i am a pushover though.

if you do nothing, watch yourself in the parking lot, seriously.

rake it in. so what if he had the best hand? he made a mental error and it's his own fault. suppose you go on tilt for an hour (also a mental/emotional error). you don't expect the chips you spewed to be given back after you cool down because it's "unfair" and you normally would have lost fewer pots if you hadn't been tilting. both are completely avoidable mistakes and i consider them a part of the game

I had a similar thing happen to me and it was an easy decision - I told the dealer to push the pot to my opponent who mucked the better hand.

I have folded the winner before, and showed, and did not get the pot back. But I also did not ask for it because I knew it was my error to being with. It's rather douchey for the guy to ask for it back at all.

However, I would offer to chop it with him. Karma. I would want the same courtesy offered to me in the future.
