Why doesn’t the language of the UIGEA already exclude poker only sites

Under the Act, if a poker site simply rented tables to each participant for X.XX, would they violate the law? No rake, and no money is wagered for the game on the site, otherwise, I pay 2.50 for the rent, but if I win the entire tournament, my poker account with Stars receives nothing.

(Of course I'm assuming that a completely separate entity existed that was a holding bin for monies, but that's not part of my question for right now.)
