[ QUOTE ] Unless you have a crapload of unpaid fines-warrants something like that, 99.99% sure no jail, unless you piss of the judge and call him a fat lazy bastard, you'll be fine. You'll just have alot of fines, depends on the state/county/city [/ QUOTE ] Whew, thanks for mentioning the fat lazy bastard thing. I was totally going to do that. Bye-Bye bankroll. I hope it's under a grand. [/ QUOTE ] Everyone who's telling you 100 percent no jail are idiots. They don't practice in your area, know your laws, know your local judges, or know your local prosecutors. Talk to a lawyer, its free, you have nothing to lose, or you're taking a real gamble. |

[/ QUOTE ] I had an intership in college @ the local county jail/sheriff's office. You would be amazed how many people would just go off @ a judge for little things like this. Say it was your mistake, admit to everything, the judge might cut you some slack and let you go for less than you think. Also if their like a city lawyer or anything, get to the court early, try to talk to him and work out a deal. It wouldn't hurt |

I'm a lawyer in New York and this is the worst possible advice you could get. Talk to a lawyer in your area immediately. |

Talk to a lawyer, its free, you have nothing to lose, or you're taking a real gamble. [/ QUOTE ] While you're correct, of course, even all of us non-lawyers have experiences with this sort of thing where we can share with him our personal experiences. Back on Halloween I appeared in court re: a litany of charges: expired tags; no proof of insurance (although I was insured); no proof of registration; speeding. The tags and the registration were handled before my court date, no biggie. But while waiting to be called I watched a whole slew of (literally) poor saps with mostly larger charges (e.g. actually NOT having insurance) and the judge was just like WTF, get this taken care of, I'll give you another couple of weeks. Today I was back in there as a follow-up, asking for an extension to go to driving school (thus no points on my driving record - I've been too busy posting in OOT to deal with that s-h-t obv). It took about ten seconds for the judge to grant me two more months to get it done. Bottom line: they sound like misdemeanor offenses, if you have no record then jail time should be ridiculous to even consider. The state just wants their fine money - my state even lets people pay on a payment plan if necessary. Yeah, but that said, consulting with a lawyer = goot. |

Because if you really do practice law, you know how crimes are treated varies widely even from county to county and judge to judge. Are you a criminal defense attorney? Because any advice other than talk to a lawyer is dumb. |

Also if it comes to it, if you end up forgetting to talk to a lawyer, you have to make it clear that as it was advertised as a moped, that a reasonable person in your situation would have thought it to be a moped, and you dont need a license for a moped, so there was no reason for you to think that you needed any of those things you were charged for.
