But I seriously doubt that this will result in anything more effective than the attempted crackdown on "illegal" filesharing...and has that worked at all?

[/ QUOTE ]

Good analogy. Let's see...

1. Napster sued and shut down, bought out, reopened legally.
2. That network with the satellite dish as the icon shut down.
2. Kazzzzza basicaly shut down, trying or tried to reopen legally.
3. Grokster sued and shut down
4. eeeeDonkey basically shut down
5. Countless bittttorent tracker sites threatened with lawsuits or actually sued, then either shut down or have their IP shut them down.
[note: site names changed to escape filters]

The way it works now with filesharing is that the sites pop up, make their money as long as they can, get shut down, then try to reopen legally. This type of arrangement works fine for their users because there is no money to constantly move around or risk losing. Also, even though most of these filesharing sites were based offshore, the US legal process was still used to affect their closure.

With poker, I'm not sure the casual US player is going to be comfortable with sites that continue to pop up and close down since their money is at risk with every closure.

Practically speaking you are right, for us it all hinges on how easy it is for the casual player to deposit money and how comfortable they feel with the new regulations in place. Personally, I think the serious US players will continue to play online somehow, but far fewer casual US players will continue to play because of real or perceived risks and difficulty in finding a site that will take their bets or transfer their money.

I think a similar process to the filesharing sites could occur with the poker sites, in they they get shut down in the US, then try to reopen under a legal aggreement with a state government. In the next year or so, the efforts will be by the Vegas casinos and online operators to start up legal and regulated sites based in the US that pay US taxes and deal with US regulations.

This legislation in no way makes online internet poker illegal.

Does that even matter if Party, Stars, Crypto and others won't take US bets? Or, if casual US players have trouble finding a method to transfer money or finding a site to take his bets?

I've read so many posts from people who have great ideas about loopholes... some even suggested dedicated forwarding european servers, kind of like a poker-proxy server

None seem to understand that average Joe who wants to gamble on saturday because his wife is out with her friends and the bowling alley is closed used to type in his credit card number, got 2 cards, and played them. Unfortunately Joe will not be playing poker next saturday if he has to register an account with a european bank and forwarding secure proxy server.

Avg Joe could pretty much never use his credit card anyway...and I think EVERYONE understands your point.

However I am entirely optimistic that someone will find a way to let Joe Sixpack continue to keep depositing in a simple, easy, straightforward manner - where he won't even notice anything is different. There is simply to much money to be made and where there is a will there is a way.

Not to mention Joe Sixpack LOVES TO PLAY POKER!!! Why do you think he keeps coming back even though he loses all the time? He wants to gamble and god dangit hes gonna gamble. Who cares if its illegal? So is smokin weed, driving drunk, stealing cable, etc etc.

The fish aren't going anywhere.

Maybe in the short term but they'll be back, and oh yeah, they'll be ready to GAMBOOL!!!
