Is kind of weird what happened there, but the guy has been on death row for 10 years for murder committed in the course of burglary, rape, and car theft. The appeal was challenging the method of lethal injection that has been generally used as being "cruel and unusual punishment". I am sure when that ammendment was written they did not mean lethal injection by "cruel and unusual punishment". I am not big in favor of the death penalty but the whole thing is Kafkaesque to start with.
