Yes. Although it might not be preponderance either (but probably is - I don't know the standard used and it also obviously varies between civil and criminal IRS proceedings.)

ok so i asked my brother who currently works for the IRS. He said that the standard for fines is super low, as in the IRS can always get you at this standard unless you are 100% perfect on your taxes. At this low standard the fine is the taxes you owe plus 20% plus interest on both the taxes and the fine.

There is a higher standard (civil fruad)where the IRS can prove intent to cheat on taxes and the fine is the taxes plus 75% plus interest.

The worst is prision (criminal fraud) once again they must prove intent but according to my bro you have to be stiffing the gov for about 40k a year for several years before they willl put you in prision.

there are a bunch of standards, the law is in your favor at the federal court level but it may be higher than 'preponderance'. I'd guess it's probably preponderance but I'm not a tax attorney so if your audit goes to federal court you should probably consult one of those.
