I think he needs a lesson in EV.

EV of screwing with 2+2er's and dealing with lawsuits / bad credit / bad background checks <<<<< EV of being busted by the government for violating internet gaming act.

I guess I was lucky and waited to see how things shook out, so I can still signup for SIA at a reputable affiliate. I am only owed $35 for Planetluck. Are they not paying you as well?

In short, the closing of CasinoCashUnlimited.com was simply an attempt to be in compliance with the Unlawful Internet Gambling Enforcement act...nothing else.

Exactly how much gambling took place on your site?

How does the bill stop you from paying people for referrals? (Notice that I am not assuming you were paid... just asking this question as it seems like you are hiding behind a law which does not apply to you or your business.)

This isn't Party Poker...your bluff is far too transparent to fool me. On what grounds will you be filing suit? Second, I don't attend a university, nor have I committed fraud.

[/ QUOTE ]

First, you did commit fraud. Second, any lawsuits will be mostly based in contract disputes. That little form you had us fill out is a contract. Lawsuits based on such contracts are perfectly legitimate, while "use at your own risk" contracts are not. The skydiving industry tried that. We're not talking about sales here ... we're talking about services. Convincing yourself that you are safe from lawsuits is a bit childish.

By the way, I'm a lawyer.

Interesting you claim to know so much about Boogster, but don't even know the rate they're getting. I'll tell you this: "not a single affiliate including Boogster gets close to that" = FALSE

That said, it is not likely I will offer another reply after this. I've explained the situation to all of you...take it or leave it.

[/ QUOTE ]

We will gladly leave it and see you in court. You are a fraud and a thief, and if you think it's that easy to screw with a site like this and disappear, you are fooling yourself.

On what grounds? While I'm a layman, I do understand the relevant law here. Civil suit would require proof of contractual obligation...which none of you have as none of you have undeniable proof of any amount owed. Further, the criminal offense of wire fraud requires that the prosecutor (government) prove that I knowingly and willfully devised or intended to devise a scheme to defraud...which cannot be proven as it did not occur! This is not to mention the fact that none of you ever gave me money...nor did I request it. You willingly deposited at affiliate sites and that's that. While I hope that none of you are so sour to file suit over $250...if you feel that is what you must do...I feel sorry for you.

In short, the closing of CasinoCashUnlimited.com was simply an attempt to be in compliance with the Unlawful Internet Gambling Enforcement act...nothing else.

[/ QUOTE ]

You certainly are a layman. Lawsuits may be filed alleging breach of contract, since your site offerred money to whomever signed up to certain sites through your affilate. Your customers accepted your valid offer and thus a contract was created. When your customers upheld their end of the contract, you were liable for your end at that point.

You will then be subject to depositions which, of course, will be under oath. If you want to continue trying to lie your way out this, you can be charged with perjury (along with other federal charges previously mentioned).

Listen to the people who are trying to give you a way out of this. They're trying to help you. Nobody wants to have to make your life miserable with lawsuits and such. They know your name, your college, your IP address, your phone numbers, your home address. Stop playing games with people. You're a kid and nobody wants to do that much damage to your future for acting like a stupid kid. Now man up and stop acting like a scumbag.

BTW, you owe me for SIA and one other casino.

FON is so drowned in dilusion at this point it's pointless trying to reason with him. I admire the folks (e.g. Chopstick) who want to help the kid out by showing him the error of his ways, but it's obviously not reaching him. Lawsuits will send the message home a lot faster. I plan to file this week. Once i do so, i'll post all the info anyone needs to do the same.

People who take the "let's give him one more chance to explain himself before taking premature action" line are silly. This is the usual scam case and he is using the usual scam tactics to stall you. The longer you take the longer he has to hide the evidence and protect the money he stole from you. Enough talk, just file the lawsuits already, damnit! I can't, I'm not a US citizen.

I think there are ways for non-Americans to sue his company.

Chopstick,

I appreciate your time and efforts in this matter. And I agree with your take on it.

I signed up through CCU to get the $250 bonus.
I also walked two of my friends through the process.

I'm disappointed most that my friends will not be getting what they expected.

I, too, hope that FON has a change of course, but if not,

I will do whatever is necessary to see that justice is carried out, civilly.

I live in Mississippi.

I completely agree but I just don't want the hassle. I wanted to make absolutely clear that his life will suck if he doesn't man up. Lawsuits aren't even the half of it as I've seen what happens to scam artists like this on the internet. By saying this, I do not mean physical harm by any means. But it will not be pretty.

I'll also second the thanks to chopstick, who's posts have been very well written and rational.

So for the record, here is my response from SIA:

Hello Jibba,

Thank you for bringing this to my attention. Unfortunatly there is little we can do to help you out in this situation. However, I am going to see about reversing his affiliate commission so that at least he will not benefit from this dishonest behavior.

Kind Regards,

You don't say? Reversing his affiliate commission? Apparently he's already been paid.
