Unless there was something inside the car, in plain view that could establish probable cause, that an illegal act had taken place, the officer had no basis to seach the car.

when i read he had a pakistani drivers license i thought "wow that is awesome that some young arab kid came to america, made a fortune playing poker, drives a bmw, and smokes pot". finding out that he is really mexican is sooo disappointing.

Do you really think that's how it works in the real world? My mom is a retired police officer. I got to ride with her many times when I was younger. Believe me, 99% of the people that think they can "beat" the cops lose.

In theory what you're saying should be true but it isn't. Who do you think the courts are going to believe...the cop or the guy who was driving like a maniac, speeding, carrying false ID, in possession of illegal drugs and paraphernalia and tested positive? My $$ goes on the cop.

I'm not trying to get in a pissing contest with anyone but some people can be naive about how things work in the real world.

100% accurate. Though it's still correct to refuse a search.

99% of the time nothing bad will happen to a cop for doing this, except maybe getting yelled at by their superior. The only way a cop would get in trouble for this is if someone sued them. Few people would waste money on suing a cop for no benefit to themselves.

At least for this, I doubt he had a choice after the weed was found in the car. In many states, it's handled the same way as alcohol: if you are suspected of drinking and driving (i.e., under the influence), you are obligated to take a breathalyzer (you can refuse, but guilt is assumed by law when you do this).
