[/ QUOTE ] If that was true, then there was a record of how much money he had on him (and potentially in his room), that any Harrah's employee could most likely of accessed (that information). While I'm not a lawyer myself, the fact that they didn't offer at that time for him to put his money in the cage safe and WARN him about the low liability in the in room safes should he of refused, could that be an opening for him to regain his money via lawsuit? I'm with the OP on this one BTW, even if he could afford the loss (as obviously he brought the money to the casino to gamble with), it is the principal of the thing. It's no different if say you or I, an average Joe or Jane, brought 3k to gamble with, could afford to lose it, but the same thing happened, all because we were not informed that $750 was the max liablilty of an in room safe break in. I mean a reasonable person would figure if the safe was there, it must be safe to keep your valuables there, otherwise why have the safe in the room in the first place. I mean they should of told him when he registered the money into play about the limitations of the hotel safe, and then he could of made an informed choice about where to leave his money when he wasn't using it. |

op, sry for ur loss, but i am diamond too, stayed at Rio last week & as far as i know there are no "diamond safes", and they can't be locked in the open position...being nitty i know, but, has the LV press picked up on this...realize that local press does not put a priority on tourist crime

I'd be just as pissed as you and I loath Harrahs but they are smart to but the max insurance at $750. At this figure it's not enough for Joe Schmoe to fake that his safe has broken into. If it was insured to 50k they'd have a bunch of people making claims so you also have to see it from their side. But I have no doubt that Harrahs probably handled this really poorly

If every casino reimbursed every guest that claimed a loss, they would be paying out daily. There are numerous scams where players claim to have been robbed when it was a setup.
This is very standard for the Rio to not pay out. I would suspect that every other major casino would handle this the same way unless they had video proof of an employee entering the room at the time of the theft. In summary: OP, you're screwed. |

No one has mentioned it yet, but Nevada Revised Statute 651.010 limits the liability of hotel owner for guest property stolen from a guestroom where a safe or vault is available. In that instance, in order to recover you would have to establish that the hotel is not just negligent but grossly negligent. That standard is tough to overcome.

How the EFF did someone get into the hotel room?? The 'perp' must have used a valid access key card to enter. When a person uses the key card (be it failed or successful) it becomes documented in their system. Security should be able to quickly narrow down a list of suspects.

1. you told the host or check in person u were putting 32k in the safe
2. they then called thier inside worker or ex worker or ex maintence to come to xx room for 32k 3. this guy knows the safes and doors cause hes worked on them for years. 4. he comes gets in door gets in safe in matter of minutes after he watches u leave your room. 5. blame the maid. i would goto step 1 and that person would be first suspect, unless sombody has access to the computer. did the check in person log anything about the 32k into the system after u told them? def. looks like a inside job. this totally sucks. i am diamond member also and have always been treated fairly. i would hate if this happend to me. good luck at recovering your money! |

What is the purpose of telling your VIP host how much money you have if there is no insurance on the safe? This seems like a huge liability for Harrah's since it's obvious that whoever you told is involved in the theft.
I also think 30K is reasonable to store in a Diamond-status safe. It's a lot of money to lose but to me it's not a lot of money to store in a locked safe in a locked room. Everyone who blames OP is merely jealous. |
